​The ownership of intellectual property can be a controversial issue when negotiating research agreements and collaboration agreements.

​

The major focus of this skills building workshop is negotiating the ownership of IP, and looking at:

​

  • Joint ownership of IP and its downsides, and how to manage joint ownership.

  • IP ownership and rights models in Research Agreements

  • IP ownership and rights models in Collaboration Agreements between a university / institute and company

  • IP ownership models in Collaboration Agreements between two or more universities / institutes.

​

Sometimes parties agree on joint ownership in the expectation that joint ownership results in equal and mutual rights. 

​

But joint ownership laws affecting patents, copyright and trade secrets more typically result in the joint owners having unequal rights. Often, joint ownership operates to the disadvantage of one joint owner, or even to the disadvantage of all the joint owners.

​

Another focus of the workshop is proven strategies to negotiate this IP ownership issue in your favour that equip you to resist demands that you concede the ownership or joint ownership of the IP you create.

​

We also focus on IP ownership defects which can hinder commercialisation, and create legal liabilities and exposures.

​

We identify common IP ownership defects, and how to fix them.

​

Lastly we deal with what is sometimes the controversial issue of IP ownership warranties.
